ADMISSIBILITY

1. • You are at least 18 years of age.
   • When using the Website and Services, you are required to adhere  to these Terms and all relevant laws and regulations determined by the country of residence.
   • You are obligated  to provide complete and accurate registration information and to ensure that this information remains accurate throughout your use of the Website.
   • SOSTEC reserves the right to terminate your access without prior notice if you breach our terms.
   • You must provide accurate registration info, including a separate email from your domain. It’s your responsibility to keep it up-to-date. SOSTEC shall not be responsible for service interruptions due to outdated contact info. You can verify or update your information via SOSTEC’s Portal. Providing false information may result in the termination of your account.
   • You must provide truthful and complete registration details, including a distinct email address not linked to your domain. It’s your responsibility to maintain accurate contact info, including domain-related details.
   • SOSTEC bears no responsible for service disruptions caused by outdated contact information. You can verify or update this information via SOSTEC’s Portal. Providing false info may result in account termination.

COMMUNICATIONS

• • When you register an Account on our Service, you are consenting to receive newsletters, marketing or promotional materials and other information that we may send.
  • If you wish to shop receiving any, or all, of these communications from us, you can do so either by following the unsubscribe link or by sending an email to sales@sostec.so.

ACCOUNTS

• • When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on Service.

  • To verify or update your contact details, you can access SOSTEC’s Portal. Providing false contact information in any manner may result in the termination of your account.

REGISTRATION, LOGIN CREDENTIALS AND SECURITY

• • In order to be able to make use of and access the Services, you shall register on the Website by providing SOSTEC with all required information which includes but is not limited to your full name, business name, address and contact information.
  • You agree to (i) provide true, accurate, current and complete information about yourself as prompted by the sign-up process; and (ii) maintain and promptly update the information provided during registration to keep it true, accurate, current, and complete.
  • Each SOSTEC account can be accessed by its/his/her holder via the Website (“Account”).
  • If you provide any information to SOSTEC that is untrue, inaccurate, outdated or incomplete, or if we have reasonable grounds to suspect that such information is untrue, inaccurate, outdated or incomplete, we may terminate your Account with us and refuse current or future use of any or all of the Services.
  • When registering an Account, as a customer, you may provide SOSTEC with your choice of Account password and username (“Login Credentials”).
  • You hereby:
    
    • acknowledge and agree that you are solely responsible for maintaining the confidentiality of your Login Credentials and for any and all activities that occur under your account;
    • agree to notify SOSTEC immediately of any unauthorized use of your account or of any other breach of security. SOSTEC shall not be liable for any loss that you may incur as a result of any third party using your Login Credentials or Account, either with or without your knowledge. However, you may be held liable for losses incurred by SOSTEC as a result of a third party using your Account or Login Credentials.

ACCESS AND USE

• • You must only use the Service in accordance with these Terms and any applicable law.
  • You must not (or attempt to):

PURCHASES

1. • If you wish to purchase any product or service made available through Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
   • You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
   • We may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.
   • We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.
   • We reserve the right to refuse or cancel your order if we suspect fraud or an any unauthorized or illegal transaction is suspected. 

TRANSFER

1. • We help in migrating your website, but please note that this service is provided as a courtesy.
   • We cannot guarantee the availability, feasibility, or timeframe for completing an account transfer. Each hosting company has unique configurations, and data may be stored in incompatible or proprietary formats, making it challenging or impossible to migrate some or all account data.
   • There may be cases where we cannot assist with data transfers from your old host.
   • The free transfer service is offered for the first thirty (30) days after your sign-up date.
   • For transfers beyond this period, please contact our Transfers department for a pricing quote.
   • SOSTEC is not liable for any data loss or missing files during a transfer to or from our services. It is your responsibility to maintain backups of your data.

DATA LOSS PREVENTION

1. • Your use of our Services is solely your responsibility.
   • SOSTEC’s weekly backup service overwrites previous backups, retaining only one week’s worth.
   • Our service is a courtesy for shared and reseller accounts, subject to modification or termination by SOSTEC at any time.
   • Dedicated accounts are not covered by this backup service. SOSTEC is not accountable for your files or data on your account.
   • You must take full responsibility for your files and maintain appropriate backups on our servers.
   • Shared accounts exceeding 20 gigabytes of disk space will no longer be included in our weekly off-site backups, except for databases which will still be backed up.
   • All data will continue to be mirrored to a secondary drive to safeguard against data loss in case of drive failure.

WORDPRESS

1. • When you install or use Automattic-operated WordPress plugins on your hosting account, such as Jetpack, you must also adhere to (1) the WordPress.com Terms of Service at (https://en.wordpress.com/tos/), which covers all Automattic products and services, and (2) the Automattic Privacy Policy at (http://automattic.com/privacy/), including their data collection practices.

SUBSCRIPTIONS

1. • Some parts of Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles  set on a monthly or annually basis.
   • At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or SOSTEC cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting SOSTEC customer support team.
   • A valid payment method, including credit card, is required to process the payment for your subscription. You shall provide SOSTEC with accurate and complete billing information including full name, address, state/province zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize SOSTEC to charge all Subscription fees incurred through your account to any such payment instruments.
   • Should automatic billing fail to occur for any reason, SOSTEC will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.

BILLING AND PAYMENT

1. • You are responsible to keep payment information current and pay invoices on time. You agree to pay for services in advance, with payments applied to the oldest unpaid invoices of the period during which such Services are provided.
   • You agree that, unless you cancel, you’ll be billed automatically renew to avoid service disruptions, using your saved billing information.
   • Listed fees don’t include taxes; they’ll be added as a separate charge to your invoice. Fees are generally non-refundable once paid.
   • Invoices must be paid within ten days; late payments may lead to service suspension or termination.
   • You agree to inform SOSTEC’s Billing department after purchasing a domain. Domain renewals are billed 45 days in advance.
     

USAGE POLICY

1. • In accordance with SOSTEC’s Acceptable Usage Policy, disk space may only be used for web files, active email, and user website content. Anything, including but not limited to movies, emails, electronic files held offsite, or FTP servers, cannot be kept in shared hosting space. Every shared account may be checked by SOSTEC, which expressly reserves the right to do so, for violations of this Agreement or the Acceptable Use Policy that might lead to a disproportionate use of CPU, storage, or other resources. SOSTEC may, in its sole discretion, cancel access to the Services for accounts that it deems to be in violation of the terms and conditions, charge additional fees, or remove or delete User Content.
   • You acknowledge that improper use of SOSTEC’s shared hosting resources, such as exceeding the 200,000 inode count limit or using more than 5GB of database space in a single database, might negatively affect server performance. To ensure optimal performance, SOSTEC may request reductions and may suspend accounts that use too many resources.
   • Unmetered bandwidth is available on shared servers, excluding resellers. Resellers adhere to the conditions of each plan in the control panel.
   • The amount of resources allotted in your selected plan determines how dedicated and VPS servers are used.
   • SOSTEC has the right to restrict or eliminate excessive cPanel accounts. Customers who go over their allotted amounts might have to pay for more cPanel accounts.

CONTEST, SWEEPSTAKES, PROMOTIONS AND DISCOUNTS

1. • Any contests, sweepstakes or other promotions (collectively, “Promotions”) made available through Service may be governed by rules that are separate from these Terms of Service.
   • If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy.
   • If the rules for a Promotion conflict with these Terms of Service, Promotion rules will apply.
   • Discounts and coupon codes are exclusively designated for new customers who are using our services for the first time.
   • Discounts and coupon codes cannot be applied to the acquisition of a domain registration, unless explicitly stated otherwise.
   • If you’ve previously registered with a specific domain and utilized a coupon, you cannot register that same domain again using a different coupon code at a later time.
   • All coupons and discounts are solely applicable to the initial purchase and do not impact the renewal or recurring fees.
   • Any account found to be in breach of these regulations may result in the suspension or termination of your account, and the necessary charges will be added to the account.

FREE TRIAL

1. • SOSTEC may, at its sole discretion, offer a Subscription with a free trial for a limited period (“Free Trial”).
   • You may be required to enter your billing information in order to sign up for Free Trial.
   • If you do enter your billing information when signing up for Free Trial, you will not be charged by SOSTEC until Free Trial has expired. On the last day of Free Trial period, unless you cancelled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.
   • At any time and without notice, SOSTEC reserves the right to (i) modify Terms of Service of Free Trial offer, or (ii) cancel such Free Trial offer.

FEE CHANGES

1. • SOSTEC, in its sole discretion and at any time, may modify Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.
   • SOSTEC will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.
   • Your continued use of Service after Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

REFUND POLICY

1. • If you have a hosting account with a 30-day money-back guarantee, you can get a full refund of shared hosting fees if you cancel within the first 30 days. To request a refund, contact our billing department by phone or LiveChat. This refund is subject to our terms and conditions and does not apply to monthly services, domain registration, VPS, dedicated servers, administrative fees, custom software setup, or additional services.
   • The money-back guarantee refund is only available for local payments , PayPal and credit card payments due to processing costs. SOSTEC reserves the right to decide on refunds.
   • No refunds are available for dedicated servers, domain names, administrative fees,Google Workspace products, custom software setup, eDURDUR POS, eDURDUR Clinic, Notary System, DUGGAAL School System and Deegaan Hotel and Restaurant Management System.
   • Subscription: The paid Subscription fees are not refundable.
   • Cancellation Process: To cancel the services, you must submit a cancellation form to SOSTEC. You’ll need to pay all fees accrued before the cancellation becomes effective. SOSTEC may refund prepaid fees for full months remaining in your subscription, minus setup fees, taxes, and applicable discounts. Cancellations for shared and SOSTEC’s Software products take effect on the renewal date, while dedicated and VPS accounts are canceled immediately.
   • Domain renewals are billed 45 days before the renewal date. To cancel a domain registration, contact SOSTEC at least 30 days before renewal. No refunds are given once a domain is renewed.
   • SOSTEC may terminate your access to the services without notice for various reasons, including non-payment, violation of terms, disruptive behavior, or legal compliance. In such cases, no refunds will be issued, and you must pay all outstanding fees.
   • SOSTEC can terminate accounts that have been suspended or deactivated for 60 days, resulting in data loss. Upon termination, user content, websites, and data will be deleted.

PRIVACY POLICY, ANALYTICS AND WORDPRESS

1. • SOSTEC is committed to protecting the confidentiality of the personal data of its users and of all those providing their information to the SOSTEC in accordance with the privacy policy published on www.sostec.so under the “Privacy Policy” heading. This policy is provided only for  www.sostec.so operated by SOSTEC Technologies and not also for www.sostec.so managed by other companies, which may be consulted by the user via links.
   • The personal data subjects have the right at any time to obtain confirmation of the existence or otherwise of such data and to know its content and origin, verify its accuracy or request its integration or updating, or correction.

   • Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of SOSTEC.
   • All code, text, software, scripts, graphics, files, photos, images, logos, and materials contained on this website, our applications, or within the services, are the sole property of SOSTEC.
   • Unauthorized use of any materials contained on this Website, our applications or within the Service may violate copyright laws, trademark laws, the laws of privacy and publicity, and/or other regulations and statutes. If you believe that any of the materials infringe on any third party’s rights, please contact SOSTEC immediately at www.sostec.so.
   • All content, trademarks, data, information or information contained in any materials, or documents used in relation to SOSTEC and the Services, including but not limited to any and all copyrighted works, software, databases, text, graphics, icons, designs, logos, graphics, hyperlinks, domain names, information and agreements (“Content”), are the exclusive property of or are licensed to SOSTEC.

   • Save as expressly set out herein and in the Contracts, you shall not acquire any right, title or interest in the SOSTEC’s Intellectual Property.
   • You may not use SOSTEC’s Intellectual Property in a manner which may (i) place the SOSTEC’s Intellectual Property at risk of losing value, and (ii) cause reputational damage to SOSTEC.
     

ERROR REPORTING AND FEEDBACK

1. • You may provide us either directly at info@sostec.so or via third party sites and tools with information and feedback concerning errors, suggestions for improvements, ideas, problems, complaints, and other matters related to our Service (“Feedback”).
   • You acknowledge and agree that: (i) you shall not retain, acquire or assert any intellectual property right or other right, title or interest in or to the Feedback; (ii) SOSTEC may have development ideas similar to the Feedback; (iii) Feedback does not contain confidential information or proprietary information from you or any third party; and (iv) SOSTEC is not under any obligation of confidentiality with respect to the Feedback.
   • In the event the transfer of the ownership to the Feedback is not possible due to applicable mandatory laws, you grant SOSTEC and its affiliates an exclusive, transferable, irrevocable, free-of-charge, sub-licensable, unlimited and perpetual right to use (including copy, modify, create derivative works, publish, distribute and commercialize) Feedback in any manner and for any purpose.
   • We shall not be liable for any typo or any information being incorrect in this Agreement, in case you have discovered such type or mistake in wording of this Agreement you may inform us about such mistake directly at info@sostec.so

EXCEPT AS PROHIBITED BY LAW, IF THERE IS LIABILITY FOUND ON THE PART OF THE SOSTEC, IT WILL BE LIMITED TO THE AMOUNT PAID FOR THE PRODUCTS AND/OR SERVICES, AND UNDER NO CIRCUMSTANCES WILL THERE BE CONSEQUENTIAL OR PUNITIVE DAMAGES.

TERMINATION

1. • We have the right to, at our sole discretion, terminate or suspend your account and deny access to the Service immediately and without prior notice or liability. This can be done for any reason, including but not limited to a violation of the Terms.
   • If you decide to terminate your account, you may simply stop using Service.
   • All provisions of Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

GOVERNING LAW

1. • These Terms shall be governed and construed in accordance with the laws of England and  Somalia without regard to its conflict of law provisions.
   • Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
   • If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
   • These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding Service.
   • Each party irrevocably agrees that the courts of London, England shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims).
   • Notwithstanding the specified agreement on jurisdiction, you and the SOSTEC shall, if any dispute arises, attempt to settle it by mutual negotiations.

CHANGES TO SERVICE

1. • We reserve the right to withdraw or amend our Service, and any service or material we provide via Service, in our sole discretion without notice.
   • We will not be liable if for any reason all or any part of Service is unavailable at any time or for any period.
   • From time to time, we may restrict access to some parts of Service, or the entire Service, to users, including registered users.

AMENDMENTS TO TERMS

   • If any provision of Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of Terms will continue in full force and effect.

FORCE MAJEURE

• • No party to this agreement will be held responsible for any failure or delay in fulfilling its obligations when such failure or delay originates from a circumstance outside of that party’s reasonable control. These factors could be anything out of the party’s control, such as a power outage, a problem with the internet service provider, a strike, a riot, a flood, a storm, an earthquake, an act of terrorism, a war, a governmental action, or any other occurrence.

1. • SOSTEC bears no liability for any potential harm your business might encounter.
   • We do not provide any explicit or implicit warranties for our services.
   • SOSTEC disclaims any warranty of merchantability and for a specific purpose including but not limited to instances where data loss arises due to delays, delivery mishaps, incorrect deliveries, or service disruptions caused either by SOSTEC.
